Federal Court Orders Freedom of Abrego Garcia from Immigration Custody
A federal judge has ruled the immediate discharge of Kilmar Abrego Garcia from immigration custody, finding his continued confinement is without lawful basis.
"Since Abrego Garcia's return from erroneous detention in El Salvador, he has been re-detained, again without legal justification," Judge Paula Xinis stated in her order.
The situation originates in a erroneous deportation to El Salvador in March, which US authorities later acknowledged was an mistake. After his return to the United States to answer human smuggling allegations, he was detained in immigration detention.
In her order, the judge noted that the authorities lacks a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
